2017: An ode to the Voiceless?

Why are the Voiceless still voiceless ?

Lambs flock. Populations vote.

Lambs bleat. Voters vote.

Lambs remain meek: they follow en-masse.

People elect leaders. They are led by those who lead the polls.

Systems are manned. Men are as machines under an automated system of governance of society.

All complain of late about a huge backlog of cases which await decision by courts of law. None though seem to seek out the cause for such a growing incidence of litigant-mentality in our society.

What has turned a situation where once judges literally swatted flies in empty court halls for lack of cases to be adjudged by them to the modern-day scenario where they sweat out in air-conditioned court-rooms,day in and day out and yet there remain an enormous number of cases pending for even decades and spilling across generations of litigants as well as a succession of judges in office.. ?

What Spurs litigation ?

Why is the Government the biggest litigant before courts of the country?

Why is there a general sense of ennui,diffidence and despair whenever even the most righteous,honest,studious, knowledgeable citizens are faced with a need to climb the rungs of hierarchy in corridors of power in the government for as innocuous a matter as obtaining an apostilisation of a gold medal certificate awarded for academics or a letter of authority issued by an ill citizen in favor of an amicus curae of the apex court ?

Why do citizens have to pay charges to the banks ,including public sector,nationalized banks for transfer of minutes via digital technology in modern era?

Why do private and foreign banks need to be permitted a free run on charging the nation’ s population under various pretexts, in carrying out their lucrative multi-national business, in our land?

Is this not a form of corruption ?

Is the system itself not caught in a web of deceit by evil few who have penetrated the seats of power and the vicious cycle resembling a snake eating it’s own tail?

Farmers need counseling and guidance on crop and planting techniques rather than being bombarded with apps on smart-phones.

Plantations, be it tea, coffee, rubber or other crops as well as farm-houses must be excluded from the tax-exemption enjoyed.

The MCA-21 site is dysfunctional on most days and professionals such as practicing company secretaries, chartered accountants, corporate lawyers and others concerned with business compliance under company/economic legislation are reduced to a frustrated pack of data-operators bothered about availability of connectivity and submitting statutory-forms,rather than advisory think tank polishing academic skills and acting as catalysts for economic growth of the country.

Why must not balance sheets of banks be turned into real statements of true state of affairs rather than continuing to be fictional pieces of publication.

Tomfoolery by systems existing under clutches of a few brigands in the Executive wing of Government have ensured that successors implanted or trained under their stewardship continue to render the Legislature or elected peoples’ representatives invalid or subservient under the mangled system of enforcement of laws. Judiciary is left a hapless spectator to the travesties and travails being merely an overseeing wing of society who is subservient to the law-making body of Parliament and State Legislatures. Even the Ordinances have a limited life-span.

Hence, it is not difficult to assess the faulty system of governance and in light of changed societal mores,plug the loopholes by disciplining the babudom, first and foremost. To one who has witnessed the functional style of various bureaucrats and interacted with retired blue-blooded Indian Civil Service babus, and over decades of alternating Governments, it is but visible as a decadent system wherein only a marginal difference exists in quality of drive, initiative, attitude, goodness, abilities and bent of mind of these movers & shakers of government machinery.

Euphemisms and empty rhetoric cannot set tight the system,unless a Prime Minister tames the bull by the horns.

All inequities are not arising only out of bad money or tax evaders. Taxation law is a singularly interesting field to the scholar of governance systems because it is a field of study which frowns on tax evasion and not tax avoidance . Intelligent planners can take advantage of loopholes in the wholly unhappy system of differential,uncertain,ever-varying tax slabs,etc. arbitrariness,uncertainty and absolute dictatorial attitudes exhibited by the tax officials. Only very few tax department personnel are as Caesar’s wife, above suspicion.

Who judges the judges, be they in court halls or in government offices ?

Who is liable or accountable in an age of digitization and call Centre, third party agents culture of operating business of the Government?

Semi-literates man these counters of licensed agents who employ rude,crude,useless,unworthy staff must of the time. This is no exaggeration but a studied view of ground reality facing citizens of this nation of a billion plus!

Mere demonetization or showering praises on the soldiers who guard our borders is not sufficient to revamp the nation.

There are cooperative banks and federations which are outside the purview of control by Government elected by vast majority of people which ought to be disciplined most urgently. End the farce of a parallel government.

A nation comprises not just of soldiers or the politicians.

Agriculturists,teachers,lawyers,doctors,para medical personnel,manual laborers,masons,brick layers,midwives,anganwadi workers,unemployed youth,and a host of other categories of citizens constitute the nation. So,it is important to address all classes with equal respect as we do the beloved father of the Nation, Mahatma Gandhi or Netaji SubashChandra Bose and Sardar Vallabhai Patel and the unknown soldier.

It is a fact ,shameful yet reality of social disequilibrium that several people still live in shadows: they neither see the sun at day nor the moon at night time. Plantation workers and honest government officials as well as dedicated workers like lawyers,nurses,surgeons fall under this class of oppressed,suffering group of human beings being subjected to untold injustice by the systems in vogue.

State spends thousands of crores of rupees to let avowed Muslim citizens fly abroad in chartered flights to perform religious pilgrimage called Haj. Few State Governments also provide such funds for Christian citizens to visit Bethlehem and Jerusalem.  Whereas no Government even whispers providing even a portion of such pilgrimages to be performed by Hindu citizens even though all major temples ,be they Jyotirlingas, Shaktipeetas,and such historical places as Kurukshetra, Bhadrachalam, Tirumala, Vaishnodevi, Yadagirigutta, Simhachalam, Thanjavur, Chidambaram, Guruvayoor, etc.are located within our motherland.

Advocates as a class have faced collective shame and social ostracization by depiction  in cinema and out of real-life experiences . They are not eligible for credit -card facilities to this date but their services are enlisted by these very Organizations when they face disputes with customers,etc.under the system in vogue!

Voiceless are voiceless.

Judicial activism ?

Vested interest groups have degenerated this vital tool of governance into multifarious counter-productive types such as political interest litigation,private interest litigation,personal interest litigation,vested interest litigation and publicity interest litigation. All a farcical exercise of fifty grey shades,so to speak …

Honest voices are stifled.

Conscientious minds are stunned to silence.

All knowing voices are muted.

Good governance merits an honest recruitment of able,tested,patriotic and asset like citizens into realms of government .

A prime minister who fails to recognize and enlist, engage or enable such live wires of the motherland into his avowed agenda of a society where all prosper and peace is ushered in with an all-round involvement of good citizens .

A nation is not made up of just the mines, minerals, soil,mud, gold, silk, reserves, vines and the mills of industry but of the people of the country.

Arise. Awake. Awaken.

May 2017 usher in a perfect lifestyle for each and every citizen of our great Republic as well as for fellow Human-beings in the rest of the world.

Speak up. Act right. Enable. Empower. Establish .
